Hmmm.
Its quite possible Innotek has a contract with IBM that allows them to posses
and use IBM sources for some things. Having such a contract and not telling
anyone would be on the verge of anticompetitive though...

If Achim/Innotek has no contract with IBM then Achim is bound to follow
the rules set up in his employee contract with IBM.
I dont know how IBMs contracts are written but the one I had myself with
a large company some years ago cleraly stated that I was never to reviel
"sensitive information" either during or after my employment.

But this is all getting really stupid:

We have a group of people that has the code and dont want to tell anyone.
They are involved in the worst possible doubletalk about whats the worst
crime posession or spreading.

Both are crimes !

Does one or three yeras in prison really matter ?

Message from the moderator !


To many doubts has been raised about the TPE distro during this week.

It seems it stops lots of people from joining and I dont want anyone to have
doubts about
the osFree opensource, free, clean code incentive.

Therefore I have decided to remove the distro from the osFree pages for two
weeks.
During that time the "legality" of the code will be examined, with open eyes. I
would like
help with this but please no "It must be the "leaked" source since I have it".

In the mean time I want us to refrain form any legalese discussion regarding
TPE, "leaked"
source or anything else.

This group is about building a free opensource OS/2 clone and I will hit down on
discussions
that stray away to much.

If you want to help building a free, clean, opensource OS/2 clone stay with us
and start working
within your abilities, otherwise get off this list !

Where in the included documents does it say its *my* TPE team ?
I assume you have read this somewhere else, or more probably
been told by someone...

My name is nowhere in the docs. I put my name in the .txt file needed
to upload to your site since you demand such a file !

You prove that a) what I uploaded is illegal in my country and b) that
I did this knowingly.

And as I stand accused I demand every evidence you have in this
case including names of the people that told you these stuff were
"illegal".

I don't know what you want to say with this but *PLEASE* don't upload
the stuff to hobbes anymore. Hobbes can get much more troubles than
other ftp servers outside the US and hobbes is *really* something we
cannot risk!!!!

so please use your own FTP servers if you really want to publish the
stuff.

If hobbes has to shut down I and a *lot* of other OS/2 users will be
very angry.

Please, stop this. The mail you have recieved is a rather normal
reaction. You have done something wrong, even if you didn't know it.
Beginning to talk about sueing helps nobody.

We are not that many in the OS/2 community, fighting each other
doesn't help us.

I just took out some space on my home ftp site for osFree.
I though of this as a preliminary place before we get a real CVS.

You dont have write access since if I give you I will get the
disk full of strange directory names with windows games in...

this dir is still empty, help out filling it.

This is the IBM device driver development tools. I assume they would be
interesting
for the kernel group to look at. Read the licence before use.

These are empty right now but I assume you all are in the progress of coding

Please note that my machine is connected with a ADSL line and my ISP does
not promise 24/7 so its not always up.

Ridiculous. So let's go on. You can't have the letter of the alphabet, music
notes and notation, strings and numbers patented nor copyrighted.

So, let's move on. We don't copy OS/2 nor any parts in it. We are fabricating
an OS/2 (*)
compatible os.
(*) OS/2 is a trade mark owned by International Business Machines.
